Sam Smiths in court
« on: Mar 19 - 2009 »
Hi everyone, there is an article in the Selby Times today about Sam Smiths losing at the Court of Appeal. They had objected to the development of the former mine at Gasgoigne Wood, near Sherburn/South Milford, which would "create hundreds of new jobs". "Judges also refused leave of appeal for Samuel Smith Old Brewery to petition the House of Lords to challenge the decision made by the Secretary of State... ...to allow the re-use of the colliery site for business activities"
Here's a link (I think): [http://www.selbytimes.co.uk/district-news/Jobs-boost-as-former-Selby.5084475.jp][/http://www.selbytimes.co.uk/district-news/Jobs-boost-as-former-Selby.5084475.jp]

I imagine that this was an expensive defeat.

And with more expensive defeats to come at the Sheffield Tribunal, poor old Humphrey is being battered from all angles.

Poor lad, it's all beginning to catch up with him now..... ;D

Who knows how his warped mind works?

But it must be important to him if he's pursued it to the Court of Appeal.

Maybe he's hoping to relocate the brewery to the Selby coalfield? ???

Sam Smiths have finally relented and (seemingly) agreed to sort out the Red Bear at Sherburn. I believe that this dispute with the Selby District council has been going on for years and has cost (again) lots in legal fees. A sudden change of heart?

A report in the Selby Times today says that over ?500,000 of Selby taxpayers cash has been spent on legal fees fighting Sam Smiths on just one planning dispute. This is over development of greenbelt land at Aberford (which Sams objected to). It now seems that  interested parties to the development include Michael O'Leary, the owner of Ryanair, and the royal family of Dubai. Which airline were the ready meals for?

Selby taxpayers' ?500,000 legal bill over stud farm that boasts Ryanair boss among its member

Published Date:  30 April 2009 - Selby Times - UK
By Staff Copy

MORE than ?500,000 of Selby taxpayers' cash has been siphoned during a protracted ten-year wrangle over a district stud farm, it emerged this week.
The money was used to fund planning and legal fees during the bitter row involving the Battlefield Stud thoroughbred racehorse breeding business at Aberford, which last year reached the High Court.

Selby District Council first approved the development ten years ago, permission that was later quashed in court following intervention from Samuel Smith Brewery.

The company has repeatedly attempted to overturn development on greenbelt land, and claimed original permission should never have been given.

But the national Planning Inspectorate has now upheld an appeal ? meaning an SDC enforcement notice, which could have seen the building razed to the ground, has been overturned.

Owner Ian Hutchinson said: "It's appalling this amount of taxpayers' money has been used throughout this dispute.

"We never wanted to find ourselves in this position, and it has been a massive drain, both emotionally and financially, for ourselves."

The farm boasts Ryanair chief executive Michael O'Leary and members of Dubai's ruling family among its clients.

SDC strategic director Steve Martin said the case had taken up a "huge amount" of the authority's resources and time.

He added: "We hope a careful study of the inspector's conclusions will help clarify the law surrounding development in the greenbelt and settle this matter."

A spokesman for Samuel Smith declined to comment.

Always in support of the Samuel Smiths Brewery - although very concerned about the current company strategy towards its staff and customers, as exercised by the Directors. We believe in promoting common sense, decency, compassion, fairness and compliance with company, employment and English law.
