I have been reliably informed that Humphrey Smith is currently driving - but also from another reliable source (via a third-party) that he was banned from driving around 4 months ago.

It has been alleged that he has previously been banned for drink-driving, and if that was the case, a second ban would be for around 3 years. However, if he was/is previously/currently banned - then I suppose it could be for something else such as driving without due care and attention, or 'driving without due care' - which would seem to be appropriate.

It's a pity he can't get banned from running a business without 'due care' - well actually he can! Under English company law, if a director acts in such away as to be avoidably detrimental to the continued existence of their company ('entity'), then they could face a fine, or even being struck-off as a company Director. Although the main Sam's company in an 'unlimited' entity, it still falls under company law. Maybe it's time for someone to contact Companies House.

So, anyone else have any information on Humphrey's current driving situation?

Yes I do believe that he is driving.  Well he was 4 weeks ago.

Nice thought Max - and a complex, expensive, legal minefield I suspect! I guess we could do with some comment from all the corporate lawyers out there (do they do pro bono?!) I'm trying to get my head around how company law could possibly become involved when there is no legal obligation to file financial returns? How could any legal action involving alleged detrimental acts be upheld in the absence of any financial information? Even if SSOB is now trading at a loss, and assuming the whole estate isn't mortgaged (that would show up at the Land Registry I think) the whole empire is still viable due to all the freeholds everywhere. Just a thought.

How do you know whether an original ban was for drink driving or not!  He manages to manipulate employment law and we all know if you have the right legal team you tend to have a better chance - unlike others.

I was told that in fact Humph was banned for using his mobile phone whilst driving and that he only got a short ban.

That sounds like a disqualification because of 'totting up' ie he already had 9 points and the 3 for use of the mobile took him up to 12 - so mandatory disqualification for 6 months if I recall correctly.

We were told a while back that Humph had been caught using his mobile and was banned, but we saw him driving his car about six weeks ago and we were told his ban was over.

Humph is definately mobile again. He turned up at my local 2 weeks ago driving this. (Part of registration number and background removed on advice of admin)
