We are also in the tribunal very soon, (not part of the northern group) but i know how they feel, i have just read his defence and he does like to think "i have won this so many times, why bother" but as we are good, honest people we felt we had to do something. We may not win but sometimes you have to stand up and be counted, H smith looks at everyone and treats us as idiots, hopefully we will irritate him a little.
Will keep you all posted on how it goes.

( sorry all but we left before we could reach the 5% surplus and before he could sack us...one thing we are going for is constructive dismissal...as we loved the job before he took over with his dickensian rules. Lots of other bits too.)]

Constructive Dismissal cases are not easy win, the burden of proof rests with the Applicant rather than the Respondent. You have to be able to show that your Employers actions amounted to a serious repudiation of a term or terms of your Contract of Employment, so serious that it brought your contract to an end.  Good Luck

Hello all
The tribunal was postponed as they had run out of rooms!! So we just have to wait a bit longer.
Not too bad on us but at least it waisted 1 day of his life (and his brothers), on the plus side we did get to read his statement and "what a comedy of lies!" He really does live in his own world, afterwards we did pop into a few sam smiths pubs (my other half does love a good Best Bitter) and we have found out that he is going down the 5% route with everyone and is having disciplinary's about it all over the shop. So quite a few of our manager friends are watching what happens to us. He is very clever but it only takes one person to catch him out (might not be us but a least we are trying). On a really great note...our new boss does not want or need this "wish surplus", so at least we dont have to make money by giving a short pint to anyone anymore (like you are ordered too by H Smith,as it is in all employment contracts with his company).

watching this case very closely and wish you all the best with your case and hope you come out on top because it will no doubt open the lid on things and floodgates too
